Data Protection and Privacy Policy

Kali places the utmost importance and closest consideration on protecting user privacy and personal data, just as we respect and abide by all applicable statutory requirements and legal provisions in data protection and privacy.

The objective of this data protection and privacy policy (hereafter the “Policy”) is to provide clear, simplified, and comprehensive information to individuals (“you”, “your” (plural), “your”) on the processing of personal data that is used by Kali, the party in charge of processing this data.

This policy covers all data processing carried out within the framework of the following scenarios:

  • Overseeing the website http://www.agencekali.com as well as submitted requests from the site’s online forms
  • Sending Kali’s newsletter to recipients
  • Recruiting new Kali employees
  • Managing Kali’s clients, vendors, and partners
  • Managing intercompany training sessions organized by Kali (to be adapted)

 

As it pertains to the aforementioned data processing scenarios, Kali is the entity in charge of determining the means and objectives, acting as manager of enforcing the applicable regulations and provisions regarding personal data, and most notably, EU Regulation 2016/679, relative to the protection of natural & legal persons, with regard to processing personal data and the unrestricted sharing of these data points (hereafter, “GDPR”).

Within this Policy, “Kali”, “we”, “our” and “our” (plural) refer to:
KALI, Limited Liability Corporation (LLC) whose headquarters is located at 12 rue Garet, Lyon 69001, France, registered with the Lyon Trade & Companies Register (RCS Lyon) under the number 538 460 163 and represented by Julien CANOT and Morad HACENE as official Managers of Kali.

Within the framework of its business activities as an advertising agency, Kali is an acting subcontractor per GDPR regulations, under the guidance of its clients, who serve as acting administrators of data processing. The conditions that govern data processing within the framework of these activities are described in Kali’s general terms & conditions of sale or in the signed contracts with its clients – and as such, are not covered by this present Policy.

1. General guidelines which apply to all data processing managed by Kali

Kali carefully monitors its data processing activities to ensure it respects its founding principles concerning data protection. This section will address applicable rules & regulations on all data processing covered by this policy. Section II explains in detail, for each data processing occurrence, the specific terms & conditions governing the implementation of this data processing.

a. Data collection minimization

Each online form on the website limits the collection of personal data to strictly necessary information – and clarifies the objectives of the data collection as well as recipients of this data.

All data required to process your requests are marked by an asterisk on each form. If you do not fill out these fields, Kali cannot respond to your requests and/or give you the requested information or services. The other information on forms are purely discretionary, allowing us to better manage your request and improve our communications and services for you.

b. Sharing your data with third parties and transferring your data outside of the European Union

We never share your personal data with other companies for sales objectives.

Each section of the data processing funnel lists out the names of internal recipients, for the sole purpose of accessing and processing the concerned data. This data can possibly be shared with technical service vendors, chosen for their expertise and their reliability, who work for us and according to our strict instructions (IT subcontractors, web server host, etc.).

We do not allow these vendors to use your personal data, except when it is necessary to provide services in our name, or to respect regulations, and we are strictly committed to making sure your personal data are protected at all times.

Kali may also be obliged to share your information with third parties when such an act is required by the law, a statutory regulation or a judicial decision, wherein this communication is necessary in order to ensure the protection and defense of our rights.

All third parties can come from countries outside or within the European Union (EU), most notably countries that do not offer the same level of data protection of your country of residence. In such cases and in accordance with statutory regulations, we will do our part to make sure we either:

  • Obtain your expressed and unequivocal consent to share your personal data with these third parties;
  • Enter into data-sharing contracts that conform to at least the type of contractual clauses adopted by the European Commission;
  • Make sure that third parties located in the United States are companies who adhere to the EU-US Privacy Shield and are registered as such with the American administration.
c. Securing your data

Kali is committed to protecting your personal data against all loss, destruction, modification, access or unauthorized disclosure. To accomplish this, Kali takes the appropriate technical and organizational measures, regarding the types of data and risks associated with their processing, in order to maintain the security and confidentiality of your personal data, and, notably, to prevent them from being deformed, damaged or accessed by unauthorized third parties.

 

These measures can include practices such as limiting data access to personnel within authorized service providers who need to access the data due to their professional functions, contractual clauses in the event of recourse to an external vendor, privacy impact assessments, regular evaluations of our practices and privacy policies, and/or physical and/or technical security measures (secure access, authentication processes, backup data copies, antivirus software, firewall, etc.).

d. Data that concerns minors

Kali’s services and activities are not intended for minors. Also, we do not knowingly collect or process personal data related to minors. In the hypothetical situation where we would be cognizant of collecting minors’ personal data without the prior authorization of the minor’s holder of parental responsibility, we would take appropriate measures to delete this personal data from our servers and/or those of our vendors.

2. Data processing conducted by Kali

 

a. The management of Kali’s website and requests submitted via online forms

When you navigate onto Kali’s website, you may choose to make a contact request via the form “Say Hello.”

 

Within the framework of these actions, and based on your consent that you gave in submitting the contact request, Kali processes and keeps the following personal data on you in order to respond to your contact request: the provided information on the form to identify you, your contact information and message content (if there is any), as well as all information communicated during later message exchanges. This data is processed by the most relevant department for as long as it takes to respond to your original request.

 

In both cases – and depending on your request and our message exchanges –  the data that is collected risks being used for other aims such as managing a quote request or training registration; this data processing is still subject to related terms & conditions.

 

We would also like to highlight that we keep track of anonymous statistics on web traffic to Kali’s website, information that does not allow us to identify you.

 

b. Data processing conducted with the purpose of promoting Kali’s services and offerings

Kali collects and uses the personal identification details and professional contact information of references at both prospective and current clients, in the aim of promoting Kali’s services and offerings.

 

This data is processed and kept for this goal by Kali’s sales team, subject to an unsubscribe request:

  • For prospective clients: for a period of 3 years starting on the last date of contact
  • For current clients: for the duration of the business relationship and then for 3 more years from the date of the end of the business relationship

 

Kali processes and uses this data for the legitimate reason of promoting its services. You can ask to stop receiving our newsletter at any moment without reason, by clicking on the “unsubscribe” link in the email message, or by contacting us directly with your unsubscribe request through one of the channels described in point 3.

c. Data processing conducted with the purpose of managing prospective and current clients as well as vendors and partners.

Kali may also process information related to your personal data when:

  • you request quotes for projects or services via the online form or by telephone
  • your company is finalizing a contract with Kali as a client, service provider, or partner

In this context, Kali will collect the following information related to:

  • The contact information given to Kali, such as the contact person indicated on the online form, the main reference for the contract, the billing contact, and all other contacts: last name, first name, work email address, work telephone number, position at the company, and all information included in messages exchanged with Kali (invoice description, etc.).
  • The signees of the contract: last name, first name, position at the company, signature

This data is intended on a need-to-know basis, for the following audiences: key contacts responsible for the business relationship and/or partnership; accounting and billing; and the various partner service providers who are specifically implicated by the request or contract.

This data is collected and kept:

  • For quotes that do not result in contracts: for the amount of time necessary to keep track of the request + one (1) year after the termination of the request (or from the last date of contact, if applicable)
  • For contracts and executing a contract: the length of the contractual business relationship
  • For the legitimate self-interest of ensuring the protection and defense of our rights in case of legal disputes, for five (5) years after the end of the contractual business relationship.

d. Data processing conducted for recruiting new employees

Kali also processes your personal data when you submit an unsolicited job application or you apply for a job listing published by Kali (via the “Careers” page on Kali’s website or job search websites such as Indeed).

In this context, your personal data is collected:

  • Directly from you during the recruitment process, and
  • Indirectly from a third party while conducting a background check on your educational history and professional references, with your permission

The data collected in these cases include: last name, first name, email address, telephone number, work experience, as well as information you share with us via your job application and/or résumé (CV) and/or job interviews: photo, skills, level of education, language skills, salary expectations, personal mailing address, interests, marital status, etc.

If you send us the contact information of a professional reference, it is your responsibility to make sure that the reference is aware and has given his or her approval of sharing that with us.

This data is collected and stored only in the context of the management of your application, on the basis of Kali’s legitimate interest and/or your consent and is not used for any other purpose, in particular commercial.

They are kept:

  • In the event of a positive outcome to an application: data relating to an employee are kept for the duration of his presence within Kali and after his departure for the applicable legal storage period.
  • In the event of a negative outcome to an application: six (6) months, unless you object.

Your personal data will in any case be destroyed at your request (see section on DPO contact details), within a maximum period of 1 month from your request.

These data are processed by the employees in charge of recruitment within Kali only and, incidentally, for technical and logistical reasons, to Kali’s subcontractors.

 

3. Exercise of your rights and contact details

You have the right to information, access, rectification, deletion and portability of personal data concerning you that are processed by Kali. You can also request a limitation and object to their processing.

When you exercise your rights, Kali processes your personal data for the purpose of managing your request (courtesy, surname, first name, copy of the identity document, nature of the request, response provided). This data is kept for a period of three (3) years, with the exception of a copy of your identity document, which is kept for one (1) year.

For any information or exercise of your rights regarding the processing of personal data managed by Kali, you can contact us by sending us a copy of an identity document bearing your signature (identity card, passport):

You can exercise your right to object to receiving our newsletter at any time and without justification, by clicking on the unsubscribe link included in the email or by reporting your objection directly via the contact methods identified above.

You also have the right to complain to the Commission Nationale de l’Informatique et des Libertés (CNIL), 3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07, about any complaint relating to the way Kali collects and processes your data.

 

4. Information on cookie management

A cookie is a small file stored on your computer that allows you to switch from one Internet page to another while keeping your browser settings.

When browsing the Kali website, you can decide whether or not to allow cookies to be placed on your computer. If you choose not to use a cookie, you may be deprived of certain features on the site.

The Kali site uses two types of cookies:

  • HS – A cookie for the current session that ensures that the site is loaded correctly when you access it via your browser. This cookie is deleted when you close your browser.
  • SVSession – A persistent cookie that identifies a user when they log in or access one of their pages. This cookie is stored by default for a period of 5 years.

The Kali website may contain links to social media platforms managed on third-party servers by persons or organizations over which the company has no control.

As such, Kali can in no way be held responsible for the way your data will be stored or used on third party servers. We advise you to review the applicable privacy policy of each third-party website to which you access through our website in order to assess how your personal data will be used.

 

6. Changes to this policy

Kali may modify the data protection policy from time to time. We will ensure that you are informed of these changes either by a special mention on our website or by a personalised warning, in particular when we send out newsletters.

 

7. Terms and conditions of use

By visiting the Kali website, you accept these Terms of Use. Kali reserves the right to modify these Terms of Use at any time. The ones on the company’s website are the latest updated version.

 

Intellectual Property

All elements of the www.agencekali.fr website (including brands, logos, designs, graphics, graphic charts, icons, structures, text content of the site) are the exclusive property of Kali. KALI word and visual trademarks (logos) are protected by intellectual property rights. Kali confers on the user a personal right of use relating to all the elements of the site which does not involve any transfer of intellectual property rights. Consequently, any use, copy, reproduction, distribution by any means whatsoever of these signs and any element of the website for any other purpose, in particular for commercial purposes, is strictly prohibited without the prior written consent of Kali. The creation of a hypertext link to all the content of www.agencekali.fr or any other technique consisting in displaying part of this site on a third party site may only be done with the written authorization of Kali, and this without altering the original information present on the site or its source.

Applicable law

These Terms of Use are governed by French law and are subject to the exclusive jurisdiction of the French courts.
